We found that these are marked by high levels of overcrowding, due to a sustained increase in prison overpopulation. Also, that institutions present handicaps to appropriate treatment programs, which violates the rights of the prison population such as health, social relationship, education and recreation. In turn, this has an impact on the achievement of the expected social objectives, which is why contradictions are produced that hinder the effectiveness of prison treatment and an adequate application of the institutional function. To understand this phenomenon, we use the conception of anomie proposed by Durkheim and the theoretical elaborations to which it supports. Based on these results, we seek to understand how the context of the pandemic deepened these problems.En este trabajo nos proponemos reconocer las condiciones de trabajo del personal penitenciario en Argentina durante la pandemia por COVID-19, considerando sus posibilidades de despliegue ante este contexto. Para ello, realizamos una revisión bibliográfica de estudios locales sobre las problemáticas preexistentes al COVID en sus lugares de trabajo, es decir, las instituciones carcelarias. Encontramos que éstas se ven signadas por altos niveles de hacinamiento, debido a un aumento sostenido de la sobrepoblación carcelaria. A su vez, presentan falencias para que el personal penitenciario pueda efectuar de manera adecuada los programas de tratamiento, lo cual vulnera los derechos de las personas privadas de libertad, como salud, cohesión social, educación y recreación. A su vez, esto impacta en la consecución de los objetivos socialmente esperados, por lo que se producen contradicciones que dificultan la efectividad del tratamiento penitenciario y una adecuada aplicación de la función institucional. Para comprender este fenómeno, nos valemos de la concepción de anomia propuesta por Durkheim y de elaboraciones teóricas a las que da sustento.
