Appealing to documentary analysis and conducted interviews, it is found that in the matter of restoration of the rights of children when they are victims of sexual abuse, attention is given based on the doctrine of irregular situation, since the child is treated as a care provider and not as a subject of rights.Resumo Este artigo analisa a restauração de direitos em crianças vítimas de abuso sexual, com base nas obrigações do Estado estabelecidas em regulamentos internacionais e nacionais que adotam a doutrina do melhor interesse da criança e o funcionamento das instituições competentes do município. de Girón (Santander), com o objetivo de estabelecer o processo aplicado pelas autoridades do Sistema Nacional de Assistência à Família. Utilizando análise documental e entrevistas, verificou-se que na questão de restaurar os direitos da criança quando é vítima de abuso sexual, é dada atenção com base na doutrina da situação irregular, porque a criança é tratada de maneira assistencial e não como sujeito de direitos.Resumen El presente artículo analiza el restablecimiento de derechos en niños y niñas víctimas de abuso sexual, a partir de las obligaciones del Estado consignadas en la normativa internacional y nacional que acogen la doctrina del interés superior del niño y el funcionamiento de las instituciones competentes en el municipio de Girón (Santander), con miras a establecer el proceso que aplican las autoridades del Sistema Nacional de Bienestar Familiar. Abstract
This article analyzes the reestablishment of rights in children victims of sexual abuse, based on the obligations of the State set forth in the international and national regulations that embrace the doctrine of the best interests of the child and the functioning of the competent institutions in the municipality of Girón (Santander), with a view to establishing the process applied by the authorities of the National Family Welfare System.
