This paper tackles the question: Can universal access to education be considered a fundamentalright? Here we analyze the implications of having excluded universal access to education from the Constitution’s chapter on basic rights. We also examine two important traditions in the field of fundamental rights. The neo liberalist tradition, which holds that only civil and political rights are fundamental rights, and the social liberal tradition, which holds that fundamental rights should include civil and political as well as economic and social rights. We then review the history that the right to an education has had in the jurisprudence of the constitutional court. The paper concludes with a critique of the higher education reform bill and some suggestions with a view to introducing universal access to education as a fundamental right.

Analisam-se as implicações que tem tido sua não inclusão como direito na Constituição no capítulo dos direitos fundamentais. Estudam-se duas grandes tradições sobre os direitos fundamentais: o neoliberalismo afirma que os direitos fundamentais são unicamente os direitos liberais civis e políticos; e o liberalismo social concebe que os direitos fundamentais são, além dos direitos liberais civis e políticos, os econômicos e sociais. Na parte final, se faz uma reconstrução do desenvolvimento do direito à educação na jurisprudencia da Corte Constitucional; finaliza com umas críticas ao projeto de reforma da educação superior e umas sugestões com o objetivo de propor a educação como um direito fundamental.En este artículo, se plantea el problema de si puede considerarse a la educación como un derechofundamental. Se analizan las implicaciones que ha tenido su no inclusión como tal derechoen la Constitución en el capítulo de los derechos fundamentales. Se estudian dos grandes tradicionessobre los derechos fundamentales: el neoliberalismo afirma que los derechos fundamentalesson únicamente los derechos liberales civiles y políticos. Y el liberalismo social concibe quelos derechos fundamentales son, además de los derechos liberales civiles y políticos, los económicosy sociales.
