Summary: The proof is a key element in the construction of the conviction of the magistrate, because only through it can verify the existence and veracity of the allegations. However, the Constitution of the Federative Republic of Brazil, to seal the illegal instruction backed by evidence, the rule stipulates that justice can not be obtained any and all costs. Moreover, there are no absolute rights, which allows the interpreter to relativize the constitutional rule when the case requires it. Despite there is no express provision in the civil procedural law, the doctrine admits exceptionally illegal evidence with the aim of bringing the judge of truth possible and attaining justice of the case.
