Summary: The analysis of comparative law, based on a study of its singularities, is an important instrument for developing a culture of competition. A study of four of the most relevant cases in comparative law (Schwinn and Sylvania, in the United States and Consten-Grundig and Pronuptia in Europe) opens up perspectives for interpretation and for system evolution, from the perspective of the rule of reason and illicitness per se, whereas the references is always the effectuation of rights in the context of the Democratic State.
