After a biographic approximation to Calamandrei's life, this study focuses on his Theory about rights from the perspective of the imbrications between political and civil rights and social rights, and on his thinking about the problematic "constitutionalization" of the social rights. On the other hand, this article describes the evolution of the author's thinking which progresses from a dogmatic and syllogistic position of the process to a modern and realistic position about the creative role of the judge and the need of collaboration between the ordinary and constitutional jurisdiction in defence of the transforming jurisdictional activity.La obra de Calamandrei además de una destacada y brillante labor de pensamiento, es un elegante, nítido y agudo trabajo de literatura, y de profunda humanidad. Tras una aproximación biográfica de Calamandrei, el trabajo se centra en su Teoría sobre los derechos desde la perspectiva de la imbricación entre los derechos civiles y políticos y los derechos sociales, así como en su pensamiento sobre la problemática "constitucionalización" de los derechos sociales.
