Summary: The Works of Calamandrei are not only a brilliant thinking labour but also an elegant clear and witty literature work with a profound humanity. After a biographic approximation to Calamandrei's life, this study focuses on his Theory about rights from the perspective of the imbrications between political and civil rights and social rights, and on his thinking about the problematic "constitutionalization" of the social rights. On the other hand, this article describes the evolution of the author's thinking which progresses from a dogmatic and syllogistic position of the process to a modern and realistic position about the creative role of the judge and the need of collaboration between the ordinary and constitutional jurisdiction in defence of the transforming jurisdictional activity.
