Its success depends not only on the existence of a harmonious set of general norms but also on the fact that judges follow a common and uniform interpretive platform. Otherwise, the instrumental value of law would be depreciated. Concerning the problem above, this paperaims to develop a series of objective criteria that judicial decisions should satisfy within the rule of law. In matters of judicial freedom and restriction, the paper attempts to reflect on the possibility to guarantee legal certainty, preserve human rights, and promote respect for dignity.El derecho suele ser entendido como un sistema de normas jurídicas que busca promover la cooperación intersubjetiva con el fin de alcanzar la paz social. Su éxito depende de que haya no solo un conjunto armónico de normas generales, sino también que los órganos encargados de aplicar las leyes tengan una plataforma interpretativa común y uniforme; de lo contrario, el valor instrumental del derecho se vería depreciado. Focalizado en ese problema, este trabajo tiene el objetivo de desarrollar una serie de criterios objetivos que las decisiones judiciales deberían satisfacer en el Estado de derecho.
