The present work deals with a scholastic and useful interpretation of the can. 1353 according to his words. Certainly, the suspensive effect established by the canon occurs only in the judicial field in the event of appeal against a sentence that imposes or declares a penalty, and in the administrative field, in the case of appeal against a decree that declares or imposes a penalty. Consequently, what is and what is not the appeal, the recourse and the penalty are analyzed; the judicial sentence or administrative decree that imposes or declares a penalty; and “a quo” and “ad quem” terms of the suspension. On the other hand, the study addresses the relationship of the can. 1353 with the cann. 1638, 1722 and 143§ 2, as well as with other controversial situations such as cases of “delicta graviora”, partial appeals or recources; retroactivity or the possibility of the ordinary to establish precautionary measures.Il tema ha come referente principale il can. 1353 del CIC. Questo canone non è stato riformato, ma la sua interpretazione è soggetta al contesto del nuovo libro VI secondo il can. 17. Questo prescritto, che appartiene alla tradizione canonica, ha il suo remoto fondamento nel diritto naturale. Il presente lavoro procede a un'interpretazione scolastica e utile del can. 1353 secondo le sue parole. Certamente, l'effetto sospensivo stabilito dal canone si verifica solo in campo giudiziale in caso di appello avverso una sentenza che irroga o dichiara una pena, e in campo amministrativo, in caso di ricorso avverso un decreto che dichiara o infligge una pena. Di conseguenza, si analizza cos'è e cosa non è l'appello, il ricorso amministrativo e la pena; la sentenza giudiziale o il decreto amministrativo che irroga o dichiara una sanzione; e i termini “a quo” e “ad quem” della sospensione.
