This article of reflection addresses the legal problem regarding the powers of the authorities for the exercise of control of the interventions that are carried out in the Historic Center of Cartagena de Indias. In this sense, it is maintained as a central thesis that it corresponds to the Institute of Heritage and Culture of Cartagena and the Ministry of Culture to exercise control over the intervention of Assets of Cultural Interest located within the area of protection and conservation of the Historic Center of the city. city of Cartagena de Indias; in such a way that it is up to these authorities to inspect the interventions carried out in the Historic Center of the city and impose the sanctions established in Law 397 of 1997 modified by Law 1185 of 2008 for the configuration of faults against the cultural heritage of the District and the Nation and the corrective measures established in article 115 of the National Police Code, in accordance with the provisions of paragraph 1 of article 198 of the same National Police Code. |
