Finally, wereflectonthefreedomofcitizensandtheroleoftheStateasguardianfortheprotectionandfulfillmentoftheirrightsasapriorityandinstitutionalobjective.Este artículo analiza el fundamento político de la libertad en Colombia, a partir de la reconstrucción de la división analítica entre los modelos de Estado para reconocer la relación entre la libertad y la aplicación del derecho. Se estudian los tres modelos de Estado propuestos por Mir Puig para identificar sus características. A partir de la diferenciación entre los tres modelos, se responde a la pregunta de cuál de los modelos corresponde a la construcción del Estado colombiano, según su desarrollo constitucional y legal.
