Transnational migratory displacement in the Latin American context has changed because of the massive Venezuelan exile. The country that was once the main host destination due to its oil wealth has become the main source of migrants. Currently, six South American countries host migrant and refugee populations, excluded by the national/foreigner binary code. This article reviews the dynamics of inclusion and exclusion in destination countries, a consequence of the application of the Criminal Law of the Enemy, which affects the restriction of immigrants’ rights and the application of criminal law as a prima ratio. A criticism is made of the oblivion of the States that leave aside their constitutional precepts in the face of Human Dignity and insert themselves once again in utopian constitutionalism. The above, in three sections 1) Contextualization of the South American migratory reality in key of friend/enemy perception and codes of inclusion and exclusion; 2) Theoretical aspects of the Criminal Law of the Enemy and rejection of the anticipated criminalization of immigrants, at the end, 3) Presentation of illustrative media cases of the stigmatizing daily life that threatens their Dignity. Final reflections invite the reader not to fall into these anti-legal dynamics.

El presente artículo afirma que la migración ha sido gestionada por medio de dinámicas de inclusión y exclusión en los países destino, como consecuencia de una aplicación del Derecho Penal del Enemigo, que incide en la restricción de los derechos de los inmigrantes y la aplicación del derecho penal como prima ratio. Actualmente, seis países de Sudamérica albergan población migrante y refugiada, excluida por vía del código binario nacional/extranjero. Se hace una crítica a los Estados que dejan de lado sus preceptos constitucionales de la dignidad humana y se insertan una vez más en el constitucionalismo utópico. El desarrollo de los argumentos se realiza a través de tres apartados: 1) contextualización de la realidad migratoria sudamericana en clave de percepción amigo/enemigo y códigos de inclusión y exclusión; 2) Aspectos teóricos del Derecho Penal del Enemigo y rechazo a la criminalización anticipada respecto de los inmigrantes y, finalmente, 3) presentación de casos mediáticos ilustrativos de la cotidianidad estigmatizante que atenta contra su dignidad.
