The right to work in the Dominican Constitution of 2010 and in the new Constitutions of the new Latin American constitutionalism cannot be seen within the traditional legal vision of labor matters. We are faced with a polyhedral right, with many manifestations and edges, which goes from the existence or not of the trial period, duties and rights, access to work and its economic and legal limitations, the figure of effective employment at work, which has been little studied in our country and by Latin American laborists, the work of immigrants, which is becoming more and more complicated in the face of the serious crisis in our countries and where we have not been able to provide a global solution, stability, unemployment insurance and freedom of enterprise. It also includes the right to work and the conventions and recommendations of the International Labor Organization (ILO) and their application in decent law; the declaration of fundamental principles and rights at work; sentences of the Supreme Court of Justice and the Constitutional Court regarding the right to work and guarantees; labor legislation and the Dominican Constitution. Balances and reflections to make solutions.

Balances and reflections to make solutions. El derecho al trabajo en la Constitución dominicana de 2010 y en las nuevas constituciones del nuevo constitucionalismo latinoamericano no puede verse dentro de la visión tradicional jurídica de la materia laboral. Nos enfrentamos a un derecho poliédrico, con muchas manifestaciones y aristas, que van desde la existencia o no del periodo de prueba; los deberes y derechos; el acceso al trabajo y sus limitaciones económicas y jurídica; la figura de la ocupación efectiva en el trabajo, que ha sido poco estudiada en nuestro país, así como por los laboralistas latinoamericanos; el trabajo de los inmigrantes, que es cada día más complicado ante la grave crisis de nuestros países y donde no hemos podido dar una solución global; la estabilidad; el seguro de desempleo, y la libertad de empresa. Comprende, además, el derecho al trabajo y los convenios y recomendaciones de la Organización Internacional del Trabajo (OIT) y su aplicación en el derecho decente; la declaración de principios y derechos fundamentales de trabajo; las sentencias de la Suprema Corte de Justicia y del Tribunal Constitucional relativas al derecho al trabajo y las garantías; la legislación laboral, y la Constitución dominicana.
