Thus, the aim is to apply these criminal offenses in a legitimate and limited manner, respecting the guarantees of every person under the lawEn el presente trabajo se explican los fundamentos y puntos de par-tida del derecho penal del enemigo en sentido funcionalista. De esta forma, se busca desmitificar su contenido y evidenciar su potencial dogmático-práctico en diferentes tipos de la parte especial. Ejemplo de ello son los delitos de sicariato, conspiración y ofrecimiento al mismo, y el delito de feminicidio, que, bajo esta perspectiva, son expresiones del derecho penal del enemigo.
