And secondly, due to the principle of qualitative equality between the different Spanish legal-civil systems in everything that is not attributed to the exclusive competence of the state. Various pronouncements of the General Directorate of Legal Security and Public Faith are questioning both principles, granting state civil law a pre-eminence that does not correspond to it, in view of the provisions of the Constitution, the Statutes of Autonomy and the Civil Code itself. The application of the civil neighborhood as a point of connection that determines the application of the common or foral civil law to Spaniards and foreigners, is not only compatible with current legislation, but would also eliminate discrimination in treatment -in both directions- in relation to estate planning.La aplicación del derecho foral a los extranjeros debería ser una cuestión pacífica. En primer lugar, aspecto al que generalmente no se le da la importancia que merece en el ámbito del derecho privado, por el principio de igualdad entre los españoles y los extranjeros. Y, en segundo lugar, por el principio de igualdad cualitativa entre los distintos ordenamientos jurídico-civiles españoles en todo aquello que no esté atribuido a la competencia exclusiva del estado. Diversos pronunciamientos de la Dirección General de Seguridad Jurídica y Fe Pública están poniendo en cuestión ambos principios, otorgando al derecho civil estatal una preeminencia que no le corresponde, a la vista de lo preceptuado en la Constitución, los Estatutos de Autonomía y el propio Código Civil.
