It analyzes that decision and, in broader terms, the advisory powers of the IACtHR, which have been enhanced over the years by the Court itself. The Court has made its advisory opinions binding in practice by including them in the conventionality control doctrine and by declaring them obligatory for the Inter-American Commission of Human Rights. The AO 26 is particularly important in that regard, because it shows how those decisions can affect the overall Inter-American System’s architecture. The main argument is that –on occasion–, procedural mechanisms –like an advisory opinion– are used to achieve purposes that cannot be attained using other means. This is mainly due, to the way advisory opinions are requested in the Inter-American System of Human Rights and the law that can be interpreted through them. Received: 04.10.2022Accepted: 05.11.2022Este ensayo tiene como objetivo analizar la Opinión Consultiva OC-26/20 (OC 26) de la Corte Interamericana de Derechos Humanos. El propósito será reflexionar –en base a esta decisión– sobre los poderes consultivos de la Corte; en especial, teniendo en cuenta que aquellas han sido fortalecidas por ella misma al punto de convertirlas en indirectamente obligatorias, en aplicación de la doctrina del control de convencionalidad y al vincular su contenido al trabajo de la Comisión Interamericana de Derechos Humanos. La OC 26 será especialmente útil en este análisis, ya que muestra cómo las opiniones consultivas de la Corte pueden afectar profundamente la arquitectura del Sistema Interamericano. El punto principal que defenderemos, es que –en ocasiones– algunos mecanismos procesales, por sus particularidades, el material legal a ser analizado por medio de ellas, o por sus efectos particulares, son utilizados con el fin de obtener aquello que no podrían ser obtenidos de otra manera.
