Although not specified in the Brazilian legal framework, it concerns a direct instrument of democracy, as revealed in people’s moral choices in defense of democracy; for instance, the dilemma that teachers in Brazilian private schools faced when, even though vaccination rates were very low, among other uncertainties, they had to return to in-person classes during the Covid-19 crisis. The dialectical method with a qualitative approach was chosen. A bibliographical review and analysis of court rulings based on moral principles to support people’s claims regarding the status of human rights in Brazil were conducted.O artigo propõe análise sobre o instituto da desobediência civil a partir da realidade periférica dos países de capitalismo tardio e sua trajetória na formulação e execução de políticas públicas emancipatórias para o enfrentamento das desigualdades vivenciadas por indivíduos em face de desmandos governamentais ou legislações consideradas injustas. Embora não positivado no ordenamento jurídico brasileiro, trata-se de instrumento direto de democracia, que se desvela a partir de práticas morais do povo em defesa da democracia a exemplo do dilema vivenciado por professores da rede privada na questão da volta às aulas presenciais, em meio à baixa vacinação da população, entre outras incertezas, em torno da Covid-19.
