The United Nations General Assembly, through Resolution 71/189 of 2016, recognized peace as a right that everyone should enjoy; however, its scope is reduced to the promotion and protection of human rights recognized in the two major covenants that enshrine civil, political, economic, social and cultural rights; and to the full scope of development. The Resolution does not elevate peace to the category of a human right, nor does it grant it the content of this type of right; therefore, it does not respond to the needs and challenges presented by current international law in dealing with international armed conflicts and structural and cultural violence. The objective of this article is to analyze the evolution of peace as a human right of solidarity within the framework of the United Nations Organization and the Organized Civil Society internationally. The documentary bibliographic methodology with critical analysis was used to define the categories of analysis related to peace as a human right. The main conclusion is that peace, more than a right, has been recognized from the perspective of an ideal that must be achieved and this is not enough, peace needs to be constituted as a human right that can be protected individually and collectively, so that it can serve as a legal tool both as a precautionary and judicial tool.

The main conclusion is that peace, more than a right, has been recognized from the perspective of an ideal that must be achieved and this is not enough, peace needs to be constituted as a human right that can be protected individually and collectively, so that it can serve as a legal tool both as a precautionary and judicial tool.La Asamblea General de Naciones Unidas mediante la Resolución 71/189 del 2016 reconoció a la paz como un derecho que toda persona debe disfrutar; no obstante, su alcance se encuentra reducido a la promoción y protección de los derechos humanos reconocidos en los dos grandes pactos que consagran derechos civiles, políticos, económicos, sociales y culturales; y al alcance pleno del desarrollo. La Resolución no eleva a la paz a la categoría de derecho humano ni le otorga contenidos propios de este tipo de derechos; por tanto, no responde a las necesidades y retos que presenta derecho internacional actual a la hora de hacerle frente a los conflictos bélicos internacionales, a la violencia estructural y cultural. El objetivo del presente artículo consiste en analizar la evolución de la paz como derecho humano de la solidaridad en el marco de la Organización de las Naciones Unidas y de la Sociedad Civil Organizada internacionalmente. Se utilizó la metodología bibliográfica documental con análisis crítico para definir las categorías de análisis relacionadas con la paz como un derecho humano.
