This nineteenth-century matrix functional to the Rule of Law reveals problems which are difficult to overcome when already in times of the Constitutional Rule of Law human rights are effectively enshrined and, in addition, are proposed fundamentally non-positive legal theories that design a renewed conceptual apparatus that supports and strengthens them. This sets up a new agenda for jurists that needs to be addressed to avoid an ideological, irrational, or inappropriate use of the law.Neste artigo, propõe-se identificar 19 consequências que implica o reconhecimento operativo dos direitos humanos sobre a cultura jurídica em geral e, em específico, sobre a atividade jurisdicional operacional ou interpretativa imperante entre os juristas. Essa matriz do século XIX funcional ao Estado de direito legal revela problemas difíceis de superar quando, já em tempos do Estado de direito constitucional, são consagrados com eficácia os direitos humanos e, de maneira complementar, são propostas teorias jurídicas não positivas que desenham um renovado aparato conceitual que os apoia e fortalece. Assim, é configurada uma nova agenda para os juristas que requer ser atendida em ordem a evitar um uso ideológico, irracional ou desapropriado do direito.El artículo se propone identificar diecinueve conse­cuencias que conlleva el reconocimiento operativo de los derechos humanos sobre la cultura jurídica en general, y, específicamente, sobre la actividad jurisdiccional operativa o interpretativa imperante entre los juristas. Esta matriz decimonónica funcional al Estado de derecho legal revela problemas difíciles de superar cuando ya en tiempos del Estado de derecho constitucional se consagran eficazmente los derechos humanos y, de manera complementaria, se proponen teorías jurídicas no positivas que diseñan un renovado aparato conceptual que respalda y fortalece a los mismos.
