This writing is divided into two parts and, in a few words, is a work on the concept of judicial activism. Specifically, it defines judicial activism from a particular norms of competence theory formulated by Eugenio Bulygin, who explains norms of competence from the constituent rules. So, we propose that judicial activism is the intentional modification of competence by the judge through his decisions. It was necessary to divide the writing into two parts to reach this result. This article presents the first part, which summarizes the main theories on judicial activism and then assesses the theories on judicial activism from individual and general criticisms. Consequently, we propose the desiderata that a definition of judicial activism must meet.

Em concreto, nele, é oferecida uma definição de ativismo judicial sob uma teoria particular das normas de competência. A teoria em questão é de Eugenio Bulygin, o qual explica as normas de concorrência a partir das regras constitucionais. Dessa maneira, é proposto que o ativismo judicial seja a modificação intencional das competências por parte do juiz por meio de suas decisões. Para chegar a esse resultado, foi necessário dividir o texto em duas seções. Na primeira parte, são resumidas as principais teorias sobre o ativismo judicial; em seguida, é feita uma crítica às teorias sobre o ativismo judicial expostas com base em críticas individuais e gerais; a partir disso, são propostos os desiderata que uma definição de ativismo judicial deve cumprir.Este escrito está dividido en dos partes y, en pocas palabras, es un trabajo sobre el concepto de activismo judicial. En concreto, ofrece una definición del activismo judicial desde una teoría particular de las normas de competencia. Dicha teoría es la Eugenio Bulygin, quien explica las normas de competencia a partir de las reglas constitutivas. De esta manera, se propone que el activismo judicial es la modificación intencional de las competencias por parte del juez a través de sus decisiones. Para llegar a este resultado fue necesario dividir el escrito en dos partes.
