The present study addresses the central problems in legal interpretation of Chilean universities’ policies and procedures on violence, harassment, and discrimination among students, due to the tension between the welfarist understanding of disciplinary procedures and feminist proposals for protecting victims’ rights. It analyzes the void-for-vagueness is- sues in defining and determining the conducts of violence, harassment, and discrimination; consent in sexual relationships; the scope of the university’s jurisdiction off-campus; and due process guarantees and evidence standard relevant to these policies and procedures. |
