However, cost analysis tends to ignore the serious impact that a project can have on the legal system, especially when it involves a legal framework that is not fully coherent with other law principles and may enable authorities to perform arbitrary actions. The authors propose this to be the case of Peru’s National Dorsal Fiber Optic Network. More than five years after its implementation, the project cannot meet the market’s needs and has led to the issuance of contradictory and arbitrary decisions. This situation has affected some constitutional principles, such as legal predictability, a cost that must be considered when implementing future projects.Es fácil identificar el costo en dinero que implica para el Estado ejecutar un gran proyecto de infraestructura. Por eso, cuando estos proyectos no traen los beneficios esperados, se les califica de ‘elefantes blancos’, porque implican un alto costo sin brindar mayores beneficios. Sin embargo, este análisis de suele obviar la grave afectación en el ordenamiento jurídico que puede causar un gran proyecto de infraestructura, especialmente si ha implicado la emisión de un marco normativo que no es plenamente coherente con otros principios jurídicos y ha derivado en un actuar de las autoridades que podría ser calificado como arbitrario. Para los autores, este último sería el caso de la Red Dorsal Nacional de Fibra Óptica. A más de cinco años de su licitación, dicho proyecto no solo ha demostrado que no responde a las necesidades del mercado, sino que también ha dado lugar a decisiones contradictorias y arbitrarias.
