It describes first some countries’ general legal systems for water regulation, mainly what their constitutions prescribe. Then, the Constitution of Chile, the legal regulation represented by the Water Code and Law 19,525, and the regulatory regulations in this regard will be discussed. Then, the results of this analysis and some critical observations will be presented.Esta pesquisa tem como objetivo principal fazer uma descrição e uma análise dogmático- -jurídicas do regime jurídico que existe no Chile a respeito das águas pluviais. Como objetivo secun- dário, tem-se a realização de uma revisão sucinta de um setor da normativa comparada acerca da existência de um regime sobre águas pluviais. Para isso, é feita primeiramente uma descrição do regime jurídico geral de regulamentação da água em alguns países, principalmente sobre o qual suas constituições políticas prescrevem. Em seguida, é analisada a Constituição Política do Chile, a regulamentação legal representada pelo Código de Águas e a Lei 19.525, bem como a legislação a respeito. Por fim, são expostos os resultados da análise e algumas observações críticas.La presente investigación tiene como objetivo principal hacer una descripción y un análisis dogmático-jurídico del régimen normativo que existe en Chile respecto de las aguas lluvias. Como propósito secundario, se contempla el efectuar una revisión sucinta de un sector de la normativa comparada acerca de la existencia de un régimen normativo sobre aguas lluvias. Para ello, se hará primeramente una descripción del régimen jurídico general de regulación del agua en algunos países, sobre todo, aquello de lo que prescriben sus constituciones políticas. Luego se analizará la Constitución Política de Chile, la regulación legal representada por el Código de Aguas y la Ley 19.525, y la normativa reglamentaria al respecto.
