Summary: The emergency measures of the Inter-American Human Rights System have been used to protect the fundamental rights of individuals deprived of their liberty in Brazil, given the precariousness of the Brazilian prison system. The purpose of this article is to analyze the performance of emergency measures as a means of implementing the commandments provided for in the American Convention on Human Rights, and it is intended to conclude whether these instruments act under the guise of legal guarantees(“garantismo”). The method adopted for the development of the work was the hermeneutic-deductive method in the collection of bibliographic data. The research used, in addition to the literature, information taken from legislation and the jurisprudence of the Inter-American Courtof Human Rights. Finally, a study will be carried out on the cases of the Prison Complexof Pedrinhasand the Penitentiary Complex of Curado, in order to verify that emergency measures act as mechanisms capable of guaranteeingthe application of human rights within the Member States, acting within the parameters of the theory of “garantismo”
