Laburpena: This commentary on case law analyzes the problem of the legal standing of the Self-Managed Network Establishment in those cases in which their activity produces dam-age. The problem has its origin in the fact that these establishments do not have their own legal personality but correspond to functionally decentralized bodies of the corresponding Health Service and, therefore, when the activity of these establishments generate damage, the question arises as to which entity that has the passive legitimation, whether it is the es-tablishment itself or the Health Service on which it depends. In this context, an analysis will be made of a Supreme Court’s ruling that upheld the legal standing of both bodies in the hypothesis raised.
