Regulación de la producción de peces ornamentales y sus efectos excluyente en la agricultura familiar en Minas Gerais, Brasil

The goal of this paper is to investigate the interrelationships between regulation and economic and environmental, proposing as a question the performance of the Brazilian State in a community of family farmers in the region known as Zona da Mata Mineira, in the Brazilian State of Minas Gerais. The study is the product of a university extension activity carried out between the years 2016 and 2018, and aimed to assist small producers in the process of legally adapting production. During the period, about five meetings were held between researchers and community members, in which the difficulties encountered by small producers in relation to the said process. The reported experiences were analyzed under the legal design of the regulatory regime of aquaculture activity in Brazil, taking as categories of analysis the attributes of normativity and facticity of the legal system. It was concluded that environmental regulation of the ??aquaculture activity in Brazil was designed for large producers, which has implied disproportionately burdens to small producers, generating an unjustified economic imbalance. As a contribution to the theory, it is proposed, at the end, the formulation of a concept of inclusive legal regulation, whose distinctive notes include social participation and the promotion of legal literacy as a fundamental right.

Estado en una comunidad de agricultores familiares en la región conocida como Zona da Mata Mineira, en el estado brasileño de Minas Gerais. El estudio es producto de una actividad de extensión realizada entre 2016 y 2018, y tuvo como objetivo asesorar a los pequeños productores en el proceso de adecuación legal de la producción. Durante el período se realizaron cerca de cinco reuniones entre investigadores y comuneros, en las que se analizaron las dificultades encontradas por los pequeños productores en relación con el referido proceso. Las experiencias reportadas fueron confrontadas con el régimen legal regulatorio para la actividad acuícola en Brasil, tomando como categorías de análisis los atributos de normatividad y facticidad del sistema legal. Se concluyó que la regulación ambiental en el área de la acuicultura en Brasil, diseñada para grandes productores, carga de manera desproporcionada a los pequeños productores, generando un desequilibrio económico injustificado.
