For this we chose a qualitative methodological approach based on interviews with members of the criminal justice. Then it seeks to analyze state punishment as a complex social institution given that such penalty has been subject to several objections in the last decades, specially due to its apparent inefficacy. Afterwards, special attention shall be paid to two elements that make up the judicial dimension of state punishment. The most relevant results presented are linked to two elements that make up the judicial dimension of state punishment. The first one is related to the institutions that judicial actors themselves consider important when analyzing State penalty imposition. The second is oriented towards the specific impact that punishment has based on perceptions shared by legal operators. In conclusion, from the interaction of both items, we analyze in greater detail some of the judicial criteria that shape the social problem of state punishment.En este trabajo presentamos un acercamiento a la categoría de institución social a partir de diferentes enfoques. Para ello elegimos por un enfoque metodológico cualitativo basado en entrevistas a integrantes de la justicia penal. Luego pasamos a analizar al castigo estatal como una compleja institución social, dado que dicho castigo viene recibiendo múltiples objeciones en las últimas décadas, especialmente por su aparente ineficacia. Los resultados más relevantes que se presentan se vinculan con dos elementos que conforman la dimensión judicial del castigo estatal. El primero está relacionado con las instituciones que los propios actores judiciales consideran importantes a la hora de analizar la administración de la sanción del Estado. El segundo elemento se orienta al impacto concreto que produce la pena según las percepciones que brindan al respecto los operadores jurídicos.
