To understand the scope of the current situation, it is convenient to consider even briefly what the IRPH consists of and the consequences that its application has entailed for the affected consumer borrowers, taking into account the factual background that led to the issuance of the aforementioned resolution, the precedent that In this regard, they included the conclusions of the Advocate General, the content of the STJUE itself and, lately and until there is any pronouncement by our Supreme Court, the most recent resolutions issued by our Courts and Provincial Courts. All these references integrate the content of this work.Mediante el dictado de su sentencia de 3 de marzo de 2020, el Tribunal de Justicia de la Unión Europea (TJUE) ha dado por finalizado el último episodio en la evolución del índice IRPH al que se ha venido referenciando casi una décima parte de las hipotecas en España, frente al resto que toma como referencia el Euribor, declarando en esencia que los consumidores podrán acudir a los tribunales a los efectos de que se declare la abusividad de la cláusula que en las escrituras de constitución de hipoteca contiene el referido índice. Para comprender el alcance de la situación actual conviene considerar siquiera someramente en qué consiste el IRPH y las consecuencias que su aplicación ha supuesto para los prestatarios consumidores afectados, atendiendo para ello a los antecedentes fácticos que motivaron el dictado de la señalada resolución, al precedente que a su respecto supusieron las conclusiones del Abogado General, al contenido de la propia STJUE y, últimamente y hasta que se produzca algún pronunciamiento por parte de nuestro Tribunal Supremo, a las más recientes resoluciones emanadas de nuestros Juzgados y Audiencias Provinciales.
