For this, discretion in general is taken as a margin of freedom in decision-making, which arises as a consequence of the indeterminacy of the Law or the delegation of power. On the one hand, there is a positive freedom (permission to choose between the different alternatives in accordance with the law). On the other hand, there is a negative freedom (responsibility of the decision-making body to implement the standards that will guide decision-making). Thus presented, discretion is an essential form for the active promotion of certain purposes and values, based on the powers conferred on legal bodies to adopt decisions taking into account the evaluations that they themselves carry out in the light of the circumstances of the specific cases; assessments that can and should be subject to control.O trabalho apresenta a noção de discricionariedade jurídica a partir de dois fenômenos diferentes, ambos normais e necessários para o Direito contemporâneo. Para isso, toma-se a discricionariedade em geral como margem de liberdade na tomada de decisões, que surge como consequência da indeterminação do Direito ou da delegação de um poder. Por outro lado, tem-se de uma liberdade positiva (permissão para optar entre as distintas alternativas conforme com o Direito). Por outro lado, tem-se de uma liberdade negativa (responsabilidade do órgão decisório de concretizar os standards que vão guiar a tomada de decisão).
