The following paper aims at showing the reach and shortcomings of formalization programs as means to fulfil the objectives traced by the Asamblea Nacional Constituyente -ANC- in terms of land redistribution. For that purpose, we describe the relevant debates of the ANC and we present the goals traced for the State in regards to land redistribution. Then we contrast these with the objectives and designs from land titling programs in Colombia. This comparison is made in two ways, the first one is a legal analysis of the programs in face of the Constitution and the second one contrasts the results from a poll conducted in areas where these programs were applied. As a conclusion, we found that land titling programs are neither necessary nor sufficient to fulfill the Constitutional mandates. |
