Summary: The introduction of a general principle of liability for the public authorities had the potential to become a major political construction and a genuine structural foundation for administrative law in our country, essential for bringing an end to the immunities of power. The constitutionalisation thereof, and the doctrinal and judicial contributions, all allow the dogma of objectivity to be challenged, as well as the autonomy of the authorities’ liability in terms of a general theory of non-contractual liability.
