Child abuse is considered a major social and health problem worldwide, especially
when it results in the minor being exposed to situations of vulnerability, risk, helplessness, or
other identical situations where their protection is necessary. Today, child abuse represents a
flagrant violation of the fundamental rights of children between the ages of 0 and 17, which affects
physical violence, psychological violence, sexual abuse, sexual or commercial exploitation, neglect
or neglect in care, total or partial abandonment, as well as other actions or omissions that may
cause damage to the physical or mental health of the minor. Most of the aggressions suffered by
the minor victims are related to cases of domestic violence, gender, sexual abuse, or child abuse,
offenses that in almost all cases link the aggressor with the minor in some way, which gives rise to
that the child is completely defenseless and the abuse continues to be repeated. The present work
aims to summarize the aforementioned thesis, which comprises an empirical investigation of a
qualitative type on the victimology of the minor, framed within the multidisciplinary nature of
criminology, basically dedicated to minors who suffer situations of risk and lack of protection or
are already subject to the measures covered by the legal situation of abandonment in Andalusia.
The investigation delves into the Andalusian system of protection of minors, going through its ins
and outs by analyzing the statements of experts of the system selected for this purpose, all of them
coming from each of the steps of the protection system, such as judges, lawyers, prosecutors , social
workers, psychologists, directors of protection centers, Ombudsman for minors in Andalusia and
highly qualified professionals from the police teams for the protection of minors of the national and
regional police forces. |
