To do this, the internal regulation of research and its associated products is analyzed in public and private research centers of the afore mentioned countries based on the deductive method with a documentary design. It is concluded that labor inventions, and particularly the legal regime of inventions obtained in the framework of an employment contract or service provision in the universities of the countries studied, has two different treatments: one general and the other specific defined by the institution which hinders the protection of the economic and intellectual property rights of the products generated by the researchers.El objetivo de la presente investigación es explicar el tratamiento legal que hacen los centros universitarios de México, Chile y España para la comercialización de los resultados que se obtienen de las investigaciones. Para ello a partir del método deductivo con un diseño documental, se analiza la regulación interna de las investigaciones sus productos asociados, en centros públicos y privados de investigación de los citados países.
