It is common among Law Professors to refer to exegesis as a radical movement attached to the literality of the law where there exists only the legislator. This work pretends to ask for the historical truth of such traditional reading by presenting such academic movement in its context with different shades so that the interested jurist in the history of his/her profession does not fall ingenuously in either a white legend or a black legend (being this last one the dominant nowadays) of the exegesis of the early XIX century. But, why to study a school which appeared so many years ago? For two reasons: a) because it is time to iuhistory to get articulated with iuphilosophy in order to allow a better understanding of the past which constitutes the comprehensive foundation of our discipline. Without purifying or shading properly the ideological discourses from the legal past, our thought around the law would get lost in its projection to the future; b) because the contemporary positivism which has been hardly criticized, has been assimilated with exegesis thus demanding us to question, now that time allows us to deal with the topic dispassionately from those who lived it, how true it is what has been said about that movement, which would allow the reader to answer how correct the designation which identifies positivism with exegesis is. Key wordsEs común entre los profesores de derecho la referencia a la exégesis como un movimiento radical, apegado a la literalidad de la ley, donde sólo existe el legislador, etc. Este trabajo busca preguntarse por la realidad histórica de dicha lectura tradicional, presentando tal movimiento académico en su contexto, con diferentes matices, para que así el jurista interesado en la historia de su profesión no caiga ingenuamente tanto en una leyenda blanca como en una negra (siendo ésta la dominante en la actualidad) de la exégesis de principios del siglo XIX. ¿Pero por qué estudiar una escuela de hace tantos años? Por dos motivos: a) Porque ya es hora de que la iushistoria se articule con la iusfi losofía para permitir una mejor comprensión del pasado, que se constituye en la base comprensiva de nuestra disciplina.
