The technological challenges, in particular digitalization and automation in the world of work, demand the governance of changes through a fair transition for workers and businesses. This paper analyzes the ways to carry out the fair transition, which consists in using to the usual ways to apply them to these realities (social dialogue and collective bargaining), having as a transversal idea that Labor Law should not lose its essence nor its protective purpose. On this regard, the obstacles faced by both social dialogue and collective bargaining are currently examined and the opportunities presented by this new reality are pointed out: adapting structures, strategies and actions, and incorporating new contents capable of responding to the technological challenge |
