It is a fact that the figure of conformity has been installed with force in our criminal proceeding generating undoubted advantages, but also doubts regard-ing the possible rights violation such as the accused right to a public trial with all the guarantees, not to confess guilt and the presumption of innocence, as well as generating a displacement of the Judge as the basic axis of the procedure in favor of the Public Prosecutor. The present work deals the conformity system, its embodiment in Spanish law and the problems it entails, while at the same time formulating some proposals for improvement. |
