For this purpose I examined several doctrinal and jurisprudential discussions related to the legal nature of the advanced payment given by the State to a private contractor in a contract, and also, the treatment that Trust Companies have had with such payments and the new regulations of the subject.No presente documento é analisado se o esquema fiduciário planteado com a Lei 1474 de 2011 garante a destinação dos recursos que são recebidos a título de adiantamento por um privado que contrata com o Estado. Para tal efeito se examinaram as discussões que foram apresentadas em relação com a natureza jurídica do adiantamento no âmbito jurisprudencial e doutrinal, e qual tem sido o tratamento que o setor fiduciário lhe tem dado a esta nova regulação e seu decreto regulamentário.En el presente documento se analiza si el esquema fiduciario planteado con la Ley 1474 de 2011 garantiza la destinación de los recursos que son recibidos a título de anticipo por un privado que contrata con el Estado.
