Summary: The Court of Justice of the Andean Community by Judgment 03-AI-2010 August 26, 2011, determined arbitration tribunals are forced to ask for judicial interpretation when notice the existence of Community rules applicable to the case, because arbitrators for their natures are included within the concept of “national courts” described in Article 33 of the Treaty Creating the Court of Justice of the Andean Community. Through the said Order, the Court created a ground for annulment of national and international arbitral awards, particularly in Colombia, in addition to those covered exhaustively in Act 1563 of 2012, the failure of the arbitrators to apply for judicial interpretation is mandatory and not made, this leads to the annulment of arbitral awards.
