Summary: The declaration of nullity of the regulations for defects of form, is subject to a dispute with different derivations that must be the subject of a special study. The traditional thesis supports the declaration of nullity for the infraction of any formality in the procedure, while opening positions that defend the need to make this position more flexible, taking into account the seriousness of the concurrent vice. In the present study, both positions are analyzed and the value of the formal elements and their importance in order to determine the material content of the general provisions is highlighted.
