We refer both to their representation for the purposes of their registration in the OEPM, as well as to the positive aspect of the right granted to their owner. This paper deals with the repercussion that these modifications have on the trade name rules. The study begins with the analysis of the new requirement of representation of the trademark, to later examine the scope and content of the requirement of graphical representation of the trade name in the light of this new trademark requirement. Next, we analyze the positive aspect of the right over the trade name and the impact that the modifications introduced in the Trademark Law have on this matter. Finally, a critical assessment of the way in which the reform of trademark regulation has been articulated is carried out, paying special attention to the regulatory provisions of the trade name.Las modificaciones introducidas en la legislación reguladora de los signos distintivos de la empresa como consecuencia de la incorporación de la Directiva de Marcas comportan ciertas quiebras y disfunciones que afectan a algunos de los aspectos esenciales de la regulación del nombre comercial. Nos referimos, en particular, tanto a su representación a efectos de su inscripción en la OEPM, como a la vertiente positiva del derecho que confiere a su titular. Este trabajo aborda estas quiebras y disfunciones. El estudio se inicia con el análisis del nuevo requisito de representación de la marca, para posteriormente examinar el alcance y contenido del requisito de representación gráfica del nombre comercial a la luz de esta nueva exigencia marcaria. A continuación, se analiza la vertiente positiva del derecho sobre el nombre comercial y la incidencia que sobre esta materia tienen las modificaciones introducidas en la Ley de Marcas.
