We also examine the scholar opinions about this concept given by the most prominent legal experts of that time as well as the ways of punishment for juveniles pondered by a group of intellectuals on the B-list in a period when juvenile punishment was different from the adult one. Besides, we aim at finding any hints in the legal practices that let us learn how magistrates make use of the discernment when making decisions influencing the child and young criminals‟ destinyEste trabajo se propone reflexionar sobre una figura legal medular en el juzgamiento de los menores de edad delincuentes entre fines del siglo XIX y las primeras dos décadas del siglo XX: el discernimiento. Configurada como tal desde la propia codificación penal, el discernimiento se irguió en el centro del debate jurídico que aquí reconstruimos sobre la punición de los menores. También nos detenemos en las críticas doctrinarias que recibió esta noción por parte de los juristas más renombrados de la época; y recalamos en las formas que una serie de intelectuales de segunda línea pensaron las particularidades del castigo de menores de edad en una época en que éste era indiferenciado del de los delincuentes adultos.
