In this essay, I present ideas about how the authoritative dimension of law can be reconciled with the substantive correction in constitutional review in the field of proportionality. In order to do this I proceed to reconstruct proportionality by means of principles theory and its elements, and then I focus on explaining how formal and substantive principles operate according to the same logic, in order to claim that balancing connects or reconciles the formal dimension with the substantive dimension. This will allow me to conclude that the claim that democratic objection to the principle of proportionality in the field of constitutional review can be refuted by means of formal principles. |
