This article studies one of its innovations, the possible civil liability resulting from the breach of the spousal fiduciary duty and its implications with respect to fault divorce, in order to draw conclusions from the reform that could be used to shed light on potential developments in Chilean law.El derecho matrimonial presenta en Chile y Argentina una evolución histórica similar durante los siglos XIX y XX, tendencia que se desvanece en algunos aspectos con la entrada en vigencia en Argentina del nuevo Código Civil y Comercial de la Nación en el año 2015.
