The special cases that will be studied in the pages that follow is that we are not against private conduct but labour incidence, that is, already known cases of publications on social networks that involve a breach of the obligations inherent in the employment contract. In cases where it will be subject to analysis the common feature will be the worker carries out an activity in their private social networks that is completely unrelated to the employment contract and the company. Arises if the company, claiming their right to that their image or reputation is not damaged, is entitled to exercise its disciplinary power against certain publications, reviews or even options to ‘like’ the working person on their networks social private.El presente trabajo analiza una cuestión que en los últimos años ha comenzado a plantearse en la realidad no solo de nuestras relaciones laborales sino en general en las de todos los países desarrollados. Se trata de la repercusión que en la relación laboral comienzan a tener las conductas privadas de los trabajadores en tanto que usuarios de redes sociales. Lo especial de los casos que se van a estudiar en las páginas que siguen es que no estamos ante conductas privadas pero de incidencia laboral, esto es, los supuestos ya conocidos de publicaciones en redes sociales que implican un incumplimiento de las obligaciones inherentes al contrato de trabajo. En los casos que se serán objeto de análisis la característica común será que el trabajador lleva a cabo una actividad en sus redes sociales privadas que resulta por completo ajena al contrato de trabajo y a la empresa. Se plantea si la empresa, alegando su derecho a que su imagen o prestigio no se vean dañados, está legitimada para ejercer su poder disciplinario frente a determinadas publicaciones, comentarios o incluso opciones de “me gusta” de la persona trabajadora en sus redes sociales privadas.
