Governments self-impose obligations in order to guarantee the prevalence of the victim's right for integral repair exceeding that of pure economic vision. These obligations include the right of true access to justice and guarantee of no repetition.Los Estados contemporáneos han determinado blindar sus actuaciones para garantizar el ejercicio del derecho a la justicia, bajo una doble direccionalidad: por una parte, en la idea de soberanía y, por la otra, por las nuevas articulaciones de la agenda global internacional en la que asumen como funciones básicas la defensa de la legalidad y el control de las demandas de legitimidad, especialmente cuando se encuentra frente a crisis humanitarias derivadas de gobiernos de facto o de conflictos armados internos.
