Summary: In the first part of the paper there is an approach on the separation between ethics and criminal law, through the formal guarantee of the legality principle. Through the possible connections between cultural norms and criminal law, the principle of offensiveness is reached, which is considered as a significant parameter of laity of the criminal law, as it allows contrasting the ethical pushes that can find shelter inside the same formal law. The paper presents the issues connected to the criminal responsibility in the context of the economic ethics, coming to the conclusion that the Italian legislator has recently developed an asymmetric policy.
