Summary: Substitute gestation or surrogate motherhood is a controversial practice increasingly often used in Mexico and in other countries as well. The Mexican regulatory framework in this area is very diverse. There have been recent legislative modifications at the local level and it is highly probable that new changes at the federal level will come soon. Mexican legal rules in force on the subject, and those that are currently being discussed in the legislative branch, do have and will have an impact in domestic cases, and also in cases that are linked to foreign legal systems. The aim of this article is to present some of the paramount aspects of substitute gestation in Mexico, in order to identify the challenges that the country must face at the domestic and international levels.
