These had not been examined doctrinally. Subsequently,
the present academic study will focus on
the contemporary legislation of North America
and the Caribbean countries; The Caribbean will
be divided into major and minor Antilles as way
to separate Central and South of the Americas. In
another chapter it will be discussed the existence
or non existence of piracy within the constitutions,
penal, civil or mercantile codes, as well as in the
active maritime laws. It needs to stablish that Caribbean
countries were legislatively more active
during piracy periods from the XVII to the XVII century.
To this day such laws are still active, despite
the absence in its contemporary criminal incidence.
It is precisely in this era where the temporality of
the legal analysis will be limited. Although, it is a
subject related to privateering patents and pillage
courts, they are treated in a different research. In
Central and South America, as well as in Europe piracy
is considered a crime, but the extension of the
same investigation requires a segmented approach.

In Central and South America, as well as in Europe piracy is considered a crime, but the extension of the same investigation requires a segmented approach.El presente trabajo es el primer capítulo que aborda el estudio del delito de piratería que se ejerce en altamar; se analizan sus premisas comunes, lo que clarificará sus elementos en el tipo penal, máxime que hay elementos de carácter subjetivo y normativo que no han sido examinados doctrinalmente. Posteriormente, el presente estudio se enfocará en la legislación contemporánea de todos los países de Norteamérica y del Caribe; esta última región será dividida en Antillas mayores y menores, a efecto de discurrir en el centro y sur del continente americano, ya que es tópico de otro capitulado, es decir, se analizará la existencia e inexistencia de la figura en mérito dentro de las constituciones y códigos penales, civiles y mercantiles, así como en las leyes marítimas relativas vigentes. Debe decirse que estos países tuvieron mayor activismo legislativo en la época pirata que se presentó del siglo XVII al siglo XVIII, y que a la fecha dichas figuras jurídicas continúan presentes, pese a la ausencia en su incidencia delictiva contemporánea. Es precisamente en esta época donde se acotará la temporalidad del análisis legal. Si bien es tema relacionado con las patentes de corso y los tribunales de presas, son tratados en una investigación diversa.
