Recent jurisprudence has chosen to equate them in terms of their nature to the statutory “company agreements”, that is, to the so-called “defectives”. Such agreements have contractual effectiveness, not regulations. However, they have general effectiveness in relation to the scope to which they are directed. Preventing a union from participating in these agreements improperly may violate their right to freedom of association. These informal agreements integrate the system of sources of the employment relationship, related to other labor standards, basically, through the principle of minimum standard, although their relationship is complex and multifaceted.Los acuerdos laborales informales representan un fenómeno antiguo que incluso preexiste a la negociación colectiva reglada, y que presumiblemente marchará en paralelo a la misma para el futuro. Surge básicamente como un instrumento para superar los formalismos y restricciones de la negociación formal y en búsqueda de mayor inmediatez en la solución a controversias laborales. La jurisprudencia reciente ha optado por equipararlos en cuanto a su naturaleza a los “acuerdos de empresa” estatutarios, esto es a los llamados “defectivos”. Tales acuerdos tienen eficacia contractual, no normativa. Sin embargo, tienen eficacia general en relación al ámbito al que se dirigen. Impedir a un sindicato participar en estos acuerdos de manera indebida puede llegar a vulnerar su derecho a la libertad sindical.
