It is proposed, then, in a possible reform of the Constitution, to convert it into a fundamental right of legislative configuration. Second, the work raises the convenience of explicitly recognizing primary health care in the constitutional text.El artículo se plantea, sobre todo, el problema de la oportunidad de constitucionalizar el derecho a la protección jurídica de la salud como un derecho fundamental en sentido estricto, concluyendo afirmativamente. En el constitucionalismo español vigente, es un principio rector constitucional y un derecho legal. Se propone, pues, en una eventual reforma de la Constitución, convertirlo en un derecho fundamental de configuración legislativa.
